Flashing High Beams OK, Leaving Them On is Not

Failure to dim headlights is a 2 -point offense with a maximum fine of $150 plus a $93 surcharge. If you were charged with this violation, a critical fact will be if you flashed the high beams or left them on for oncoming traffic.
Just flashing high beam headlights, alone, is not a violation of the law requiring dimming of headlights to prevent dazzling light from interfering with oncoming motorists. Vehicle and Traffic Law § 375(3), People v. Rose, 67 A.D.3d 1447 (4th Dep't 2009).
