Fines for §1180(f) - Speeding in a Construction Zone

Understandably, speeding in a construction zone can be a sensitive subject with prosecutors and judges alike. Therefore, plea bargaining for a reduction on a §1180(f) ticket is often much more difficult than a standard speeding ticket.

8 Points for ALL Work Zone Speeding:
As of February 16, 2026, all Work Zone speeding tickets are 8 points, regardless of your speed. Because this exceeds the 6-point threshold, a conviction will automatically cause a Driver Responsibility Assessment (DRA) from the New York DMV. The DRA is $300 for the first 6 points, plus an additional $75 per point over 6. This assessment will be due in addition to the court fine and applies to all drivers regardless of where they are licensed to drive.

1. Fines and Possible Jail

The base fines for speeding in a work zone escalate rapidly depending on how fast you were traveling and whether you have prior convictions within the last 18 months.

2. License Suspensions & Revocations

  • Standard Drivers: There will be a 60-day license suspension for two convictions in 18 months for speeding in a construction zone. License revocation will occur after a third conviction in 18 months.
  • CDL Drivers: One conviction of 15 mph or more over the limit will cause a 60-day license suspension. After a second conviction within 3 years, there will be a 120-day suspension.

3. Mandatory State Surcharges

In addition to the fines and DRA fees listed above, New York State adds a mandatory surcharge to every conviction:

  • $93 for town and village courts
  • $88 for other courts (e.g., city courts)
