Fines for §1180(f) - Speeding in a Construction Zone

Understandably, speeding in a construction zone can be a sensitive subject with prosecutors and therefore plea bargaining for a reduction is often more difficult.

Fines and Possible Jail

for the first conviction in 18 Months
  • $90 - $150 - For 10 mph over the limit or less.  No possible jail. 
  • $180 - $300 - For 11-30 mph over the limit. Up to 30 days in jail.
  • $360 - $600 - For 31 mph or more over the limit. Up to 30 days in jail. 
for the second conviction in 18 Months
  • $90 - $300 - For 10 mph over the limit or less. No possible jail. License Suspension.*
  • $180 - $450 - For 11-30 mph over the limit. Up to 30 days in jail. License Suspension.*
  • $360 - $750 - For 31 mph or more over the limit. Up to 30 days in jail. License Suspension.*
for the third conviction in 18 Months
  • $90 - $525 - For 10 mph over the limit or less. No possible jail. License Revocation.*
  • $180 - $675 - For 11-30 mph over the limit. Up to 30 days in jail. License Revocation.*
  • $360 - $975 - For 31 mph or more over the limit. Up to 30 days in jail. License Revocation.*

*There will be a 60-day license suspension for two convictions in 18 months for speeding in a construction zone. License revocation will occur after a third conviction in 18 months.

*For CDL drivers, one conviction 15 mph over the limit will cause a 60-day license suspension. After a second conviction within 3 years, there will be a 120 day suspension.

Mandatory Surcharge

  •     $143 for town and village courts
  •     $135 for other courts, e.g. city courts

Points for Speeding Convictions

  • 1-10 over the posted limit - 3 pts
  • 11-20 over the posted limit - 4 pts
  • 21-30 over the posted limit - 6 pts** ($300 DRA)
  • 31-40 over the posted limit - 8 pts** ($450 DRA)
  • over 40 over the posted limit - 11 pts** ($675 DRA and license suspension)

**A conviction for 6 points or more in any 18 month period will cause a Driver Responsibility Assessment (DRA), from the New York DMV, in the amount listed. This assessment will be due in addition to the court fine and applies to all drivers regardless of where they are licensed to drive.

I was coming back home (Canada) when I got pulled over for doing 81 in 65 zone. I had no clue as in what to do. As a a 60 year old physician I am semi-retired and my wife and I travel the country to do work in my specialty at places that are shorthanded. Since I only work about 1/3 of the year we have time to drive to these places. Recently I was stopped on a highway in NY. I haven't had a speeding ticket since I was in my twenties. The officer said I was doing 81 in a 65 MPH zone (my reading 76 while trying to pass a slow moving vehicle with a line of cars behind me trying to get by me as well). I read the reviews and chose Attorney Azria.

The office staff was pleasant and efficient, and put me right through to Attorney Azria. He explained the process with perfect clarity and went to work. Although he explained the process could take 4-6 weeks he resolved the issue in 10 days, reducing the violation to a non-moving violation with a small fee and no points. His price was more than fair.

I've been lucky enough as a physician to have never been sued but doctors by nature do not have an affinity for lawyers. However, if you find yourself in need of one, it is hard to imagine someone better at their job than Attorney Azria. Thank you sir. If I could give you 6 stars out of 5 I would.
