Summary of Court Fines for NY Speeding Convictions

By Seth M. Azria, Esq.

New York Vehicle and Traffic Law section 1180 deals with speed restrictions and sets out the consequences imposed by a court upon a conviction. The amount of the fine that a court may assess is based on the specific section stated on the ticket, the speed over the limit, and the number of previous convictions.

The fines are in addition to the state surcharge, DMV points, and any adverse affect a speeding conviction may have on your insurance premiums and/or coverage.

Additional Hidden Penalties:

If you have 3 speeding convictions in any 18-month period, the DMV will suspend your driving license. And then there is the DMV Driver Responsibility Assessment for having more than 6 points in 18 months.

Speeding in School or Construction Zone

If your ticket states that you violated 1180C, 1180D2, or 1180F of the New York Vehicle and Traffic Law, the possible fines for a guilty plea or conviction vary based on your speed and are:

  • Not more than 10 mph over: $90 - $300 + Surcharge
  • Between 11 - 30 mph over: $180 - $600 + Surcharge (and/or imprisonment up to 15 days)
  • More than 30 mph over: $360 - $1,200 + Surcharge (and/or imprisonment up to 30 days)

Exceeding 55mph or Posted Speed Limit

If your ticket states that you violated 1180D or 1180B, the possible fines for a guilty plea or conviction are:

  • Not more than 10 mph over: $45 - $150 + Surcharge
  • Between 11 - 30 mph over: $90 - $300 + Surcharge (and/or imprisonment up to 15 days)
  • More than 30 mph over: $180 - $600 + Surcharge (and/or imprisonment up to 30 days)

Imprudent Speeds

If your ticket states that you violated 1180A or 1180E, the possible fines for a guilty plea or conviction are:

  • Between $45 and $150 + Surcharge

Surcharges

  • If you are convicted in a city court, the surcharge is $88.
  • If you are convicted in a town or village court, so-called justice courts, the surcharge is $93.

Increased Fines for Additional Violations

The fines also increase based on how many speeding convictions you have on your record. The fine will increase by $150 for the 2nd conviction of any speeding within the previous 18 months. The fine will increase by $375 for the 3rd conviction of any speeding within the previous 18 months, and/or imprisonment up to 30 days.

Had 2 tickets that he helped get rid of the points added onto my license. Very helpful and friendly about answering questions on the process. He went in place for me in court and defended. All I had to do was email him information over email (and pay of course).

Making this short and simple: I had over 15 traffic infractions/violations for driving without a license, speeding and among other serious infractions. Needless to say , Ralph took care of this all for me and I ended up just paying fines for the traffic tickets - Also , I'm a licensed driver now!

Thanks a lot Ralph for your service , I would recommend anyone who gets in trouble with the law to first contact Ralph Habib.
