South Carolina Drivers: Impact of New York Traffic Convictions

By Seth M. Azria, Esq.

South Carolina Treats Out-of-State Tickets Just Like In-State

South Carolina and New York are both participating members of the Driver License Compact, an interstate agreement that requires member states to share information about traffic convictions.

The "Home State" Rule: If a South Carolina driver is convicted in a New York court of any speeding ticket or moving traffic infraction, the South Carolina Department of Motor Vehicles (SCDMV) will process the conviction as if the violation occurred in South Carolina.

Why You Must Protect Your South Carolina Record

It is critical to minimize or fight a traffic ticket in New York to protect your driving record back home. Pleading guilty by mail triggers multiple costly penalties:

  • South Carolina Points & Suspensions: South Carolina will apply corresponding penalty points to your home driving record. Under the SCDMV Points System, accumulating 12 or more points will result in the suspension of your South Carolina driver's license.
  • NY DMV Driver Responsibility Assessment (DRA): All drivers—including tourists—are subject to New York’s Driver Responsibility Assessment law. This law requires a mandatory surcharge (starting at $300) from any driver who accrues 6 or more points in New York within a 24-month period. Just one speeding ticket for 21 mph over the limit is 6 points instantly.
  • Insurance Premium Hikes: Because the states actively share information and the SCDMV will permanently record the conviction, your auto insurance carrier will likely discover the offense and raise your premiums.

Justice for Traffic Violations

I was wrongly issued a ticket by a police officer who made a snap decision that was incorrect. I contacted Seth for help. He wanted to know the nature of the violation and my side of the story. He then told me to sit back as he would take on the matter for me. He updated me regularly as he communicated with the court, and eventually resolved the matter for me. His fee was reasonable and the results were excellent. I highly recommend him.

Excellent job done!!

Seth Azria saved me such heartache when I received a speeding ticket on Thanksgiving day...of all days of the year.
Seth was able to negotiate a much lesser charge and fine and I am truly thankful!

Google Review

I had a speeding ticket in NY state in may. I was within 20-30 miles over the limit and it would have been 6 demerit points in NY state. After checking lawyer reviews in google and talking to few firms, I decided to go with Seth. He was very prompt in answering all my questions before I signed up with him and also after that. He got my 6 demerit points reduced to 0 and made it a parking violation charge. I strongly recommend Seth.
