Indiana Drivers: Impact of New York Traffic Convictions

Indiana Counts New York Convictions on Indiana Records

Indiana and New York are both participating members of the Driver License Compact, an interstate agreement designed to exchange information concerning license suspensions and traffic violations of non-residents.

The Equivalent Point Rule: If an Indiana driver is convicted of a traffic infraction in a New York court, the Indiana Bureau of Motor Vehicles (BMV) will add the conviction to that driver’s Indiana record. Furthermore, Indiana will evaluate the New York offense and assess points to your license based on the equivalent Indiana traffic code.

Hoosiers Should Take Care of New York Traffic Tickets

Here are three critical reasons Indiana drivers should never simply plead guilty to a New York traffic ticket:

  • Indiana Points: Indiana will add the out-of-state conviction to your record back home and assess the corresponding penalty points.
  • NY DMV Driver Responsibility Assessment (DRA): All drivers ticketed in New York, regardless of where they hold a license, are subject to New York’s Driver Responsibility Assessment law. This law mandates a costly fee (starting at $300) from any driver who accrues 6 or more points in New York within an 18-month period. Just one speeding ticket for 21 mph over the limit carries 6 points instantly.
  • Insurance Hikes: Because the states share information and Indiana will permanently add the conviction to your driving record, it is highly likely that your auto insurance carrier will discover the offense during routine audits and respond by raising your premiums or dropping your coverage.

I was entirely satisfied with the representation I received from Azria and Bruffett. In May 2018, I received two tickets for failing to stop adequately at a stop sign (the officer said it was a "rolling stop") and failure to signal more than 100 ft. before a turn. I had never had a moving violation in 20+ years of driving, and I was now suddenly facing 5 points and the possibility of a hefty fine!
