Stop Signs: What, Where and Who
by Seth Azria on 1/02/2024
What
Failing to stop for a stop sign violates New York vehicle and traffic law section 1172a. If convicted, or plead guilty, a driver will:
- be fined a maximum of $150,
- pay a $93 (or $88 in cities) surcharge; and,
- have 3 points added to their driving record.
Where
A driver approaching a stop sign must stop at a clearly marked stop line. If there is no line, then the driver must stop before entering the crosswalk. If there is no crosswalk, the driver must stop nearest to the intersecting roadway with a view of the approaching traffic but without entering the intersection. NY VTL 1172
Who
All drivers must stop at stop signs. But not those drivers who act involuntarily because of unforeseen seizures and blackouts and was unconscious at the time the car ran the stop sign. People v. Soe, 9 Misc. 3d 1069 (J. Ct. 2005).
