South Dakota Drivers: Effect of New York Traffic Ticket Convictions

by Seth Azria on 3/10/2023

If you receive a traffic conviction in New York State, South Dakota will be notified of the offense as both states are members of the Driver License Compact.

South Dakota uses a points system, which assigns certain point values to different driving offenses and traffic violations.  Any driver who accrues 15 points in 12 consecutive months or 22 points in 24 consecutive months, is subject to suspension.

Points are assessed on out-of-state-convictions just as if the violations were committed in South Dakota.

If you are a South Dakota driver and want to obtain a copy of your driving record, you may do so here.

Insurance Premium Increases are Still a Concern

Most importantly, it is likely your insurance company will learn of your New York conviction and may increase your premiums or drop coverage. It remains important to mitigate the charge as much as possible.

Minimize the Effect of All Traffic Tickets

Our goal at Azria & Bruffett is to minimize the effect of your New York traffic ticket both in New York and in your home state. One important point to keep in mind is that even if you are licensed in South Dakota, the New York State DMV will still fine you if you accumulate 6 points in any 18 month period - these fines are called a “Driver Responsibility Assessments.”

What A Find!

I received a four point ticket and googled attorney's to choose who could handle my case, being that I was not local to the county in which I received the Summons. I found Seth Azria's Law firm and read the testimonials. I liked what I read and reached out to him. After retaining his services, I found the testimonials to be spot on. My ticket was reduced to a non point, non moving violation. Later on my son received the same type ticket with the same outcome. Very pleased with the services that he provided.

The lawyer was extremely easy to work with. He guided properly on the process. I had a speeding ticket and advised about the “ Tioga traffic diversion program” that can help get the ticket dismissed.
